DWI EDUCATION CLASS OVERVIEW

Texas approved 12 hour dwi education program is mandatory for anyone charged with a 1st Offense or Obstruction of a Highway who is convicted and sentenced to community supervision (e.g., probation or deferred adjudication). Many people take dwi class in advance of any court appearance.

Specific course topics include drug and traffic safety problems, Texas laws relating to DWI, effects of drugs on humans, drugs and driving task abilities, chemical dependency, symptoms of dependency, sources of assistance, costs of DWI, and decision making.

Understanding DWI Education Program Requirements in Texas: Article 42.12, Section 13(h) Explained

Article 42.12, Section 13(h) of the Code of Criminal Procedure mandates that individuals convicted of a first offense of driving while intoxicated (DWI) and placed on probation must participate in an educational program. It is imperative for the individual to complete this program successfully.

Failure to do so within 180 days from the probation grant date, unless an extension is granted, will lead to the revocation of the offender’s license. The license cannot be reinstated until the educational program is satisfactorily completed. The standard duration of the program is 12 hours.

I recently completed a DOEP class through Alamo Center via Zoom, and overall it was a very positive experience. The instructor, Haley, did a great job keeping the class simple, informative, and easy to follow. She created a comfortable, easygoing environment that made it easier to stay engaged throughout the course.

The staff were also very communicative and understanding, which made the entire process smooth from start to finish. Instructions were clear and straightforward, so there was never any confusion about what was expected.

If you’re required to take this type of class, this is a solid option that makes the experience as stress-free as possible.

Under Texas law, the Department of Public Safety (DPS) has the authority to revoke or suspend a driver’s license if the individual fails to complete the required DWI Education Class within 180 days of their sentence. However, a suspension can be avoided if the judge grants an extension, which cannot exceed one year from the date of conviction. To request an extension, a written motion must be filed in the convicting court. If you’ve missed the deadline for completing the DWI Education Class and are facing license suspension, it’s crucial to consult with the lawyer who handled your case for guidance.

If your license gets suspended for failing to provide DPS with proof of completing the DWI Education Class, you’ll require an occupational license to legally drive. Without it, you risk arrest and charges such as Driving While License Invalid or Driving While License Suspended. To prevent such scenarios, you must request an occupational license from the convicting court for the DWI offense. Seeking assistance from a lawyer experienced in occupational license cases can streamline the paperwork and process of obtaining an occupational driver’s license.
